Smokefreerockquest Conditions of Entry

Eligibility

1. All contestants must be enrolled in and attend a school for at least 15 hours a week. If you leave school during the course of the competition, you become ineligible to continue. You can change schools during the competition. (School means secondary, area, intermediate, primary or correspondence school.)
2. All contestants must be no older than 19 (nineteen) years of age on 1st May 2010. (You may be asked to supply proof of eligibility.)
3. Smokefreerockquest is for unsigned bands and individuals only. No contestant/s can sign a recording contract prior to or during the competition without the prior written
approval of Rockquest Promotions Ltd.
4. A student can only enter in one Smokefreerockquest band.
Conduct
5. By entering this competition, all entrants are making a declaration of their smokefree status and will be required to sign the following declaration at the heats.

Smokefree Declaration

Smokefree supports Smokefreerockquest and Smokefree Pacifica Beats to give emerging musicians the opportunity to play their sounds to crowds throughout the country. Because you are the essence of these events, we ask that you respect their smokefree status. “As an entrant, I understand that for interviews, heats, Regional Finals and National Finals, press conferences, and T.V. or radio appearances, it is a requirement for me to be smokefree. If I, or any of my group members, fail to comply with this declaration, it will result in the groups’ immediate exclusion from all parts of this event.”

6. The use or possession of alcohol, cigarettes or illegal drugs by any group member at any Smokefreerockquest 2010 event will result in the instant disqualification of their entire group.
7. At Smokefreerockquest you are representing your school. It is important that you adhere to your school’s policies regarding behaviour in public. If in doubt seek the guidance of your teachers.
8. Any entrant defacing or destroying Smokefreerockquest property or property/venues used by Smokefreerockquest will be disqualified and held accountable for damages. This includes P.A. equipment, recording studios, heats and final venues, accommodation venues as well as any place used for photo shoots or interviews e.g. radio stations.
9. Smokefreerockquest does not condone censorship. Smokefreerockquest does support the NZ music industry and therefore urges entrants to consider the commercial potential of the material they write. While not wanting to put constraints on the creative process of songwriters we would like to point out that sexually explicit lyrics or lyrics that may offend may not have commercial potential and therefore may not suit this competition. Judges for this event are drawn from the NZ music industry. Entrants are urged to consider this point carefully.

Performance Requirements


10. Band members cannot be changed or added after your heats performance.
11. All parts, vocal and instrumental, must be performed live.
12. All performed songs must be original.
13. Performances at the Regional Finals must not exceed 7 (seven) minutes in duration. At the heats, play one song only.

Judging Process

14. Heats and Finals Judging decisions will be based on points, discussion, industry experience and knowledge.
15. The Judges’ decision will be final and no correspondence or discussion will be entered into.

Other Conditions & Requirements


16. All students 16 and over are required to sign the Entry Form (or if under the age of 16, must have the signature of their parent or guardian on the entry form), giving consent to us to release contestant information, images and recordings to media and sponsors, and agreeing to all conditions of entry.
17. Contestants consent to receiving promotional material from the event organisers and sponsors.
18. Contestants consent to being included in other competitions created for the benefit of the event and performers.
19. The Top 12 bands may become part of the Smokefreerockquest TV Show. None of these contestants can sign a recording or management contract prior to 31 Dec 2010 without the prior written permission of Rockquest Promotions Ltd. and the TV Show producers.
20. Bands competing in the National Final will not be permitted to perform songs at the National Final that are entered in, have been entered in, or will be entered in other music competitions in this calender year.
21. The top 12 bands agree to Rockquest Promotions Ltd. acting as their exclusive agent in all matters regarding recording contracts until 1 May 2011.
22. Contestants are required to gain approval from the organisers to use props, clothing or equipment bearing product branding of products other than those of our sponsors. Approval will not be withheld unless the organisers believe the security of the event sponsorship is at risk. This does not apply to the normal name branding appearing on musical instruments.
23. By virtue of entry the entrant agrees to hold Smokefreerockquest and its agents indemnified against any breach or infringement of copyright or rights held by any third party/parties, and the entrant undertakes to observe all such rights statutory or otherwise. By virtue of entry the entrant agrees to hold Smokefreerockquest and it‘s agents indemnified against any claim or liability for loss or accident resulting from any individual’s involvement in the event.

REGIONAL FINALS “QUIZ” TEXT COMPETITION


HOW TO ENTER

Correctly answer the multi-choice Quiz questions as shown at the Smokefree Rockquest Regional Finals on the big screens. There are 15 questions in total, and one correct answer per question per mobile number is deemed as one entry into the prize draw to win 1 of 5 ipod nanos.

Texts cost 20c each.


TERMS & CONDITIONS

1) Entry into this promotion by participation is deemed acceptance of these Terms & Conditions.

2) This Promotion is only open to “Eligible Entrants”, being individuals who: (i) are residents of New Zealand; and (ii) are not employees of Smokefree (HSC) or Rockquest Promotions (the Event Organiser), or any of its related corporations or any of their agencies associated with the Promotion; and (iii) are not a spouse, defacto spouse, parent, child or sibling (whether natural or by adoption) of such an employee, and anyone else professionally connected with the Event.

3) The Event Organiser reserves the right to verify the eligibility of entrants and check their identity.

SCHICK STYLE AWARDS - TERMS AND CONDITIONS 
1. Information on how to enter forms part of the terms and conditions of entry to the Promotion. Entry into the Promotion is deemed acceptance of these terms and conditions.
2. The Promoter is Fox Interactive Media New Zealand Limited (Company Number: 2109189), c/o Level 7, 241 Commonwealth St, Surry Hills, NSW 2010 (“Promoter”).
3. The Promotion commences at 1pm (NZST), Tuesday 6 July 2010 and closes at 4pm (NZST) on Tuesday 31 August 2010 (“Promotion Period”).
4. Entry is open to residents of New Zealand aged 16 years or over who are MySpace members (“Eligible Entrants”).
5. Directors, management, employees, officers and immediate families of the Promoter and its related bodies, and employees of associated agencies involved in this Promotion are ineligible to enter this Promotion.

Entry
6. In order to participate in this Promotion and be eligible to win, an Eligible Entrant must during the Promotion Period, visit www.myspace.com/sfrq and submit their name, gender, email address and vote for the band they think has the most style (“Eligible Entry”). The Eligible Entrant must agree to these terms and conditions. Eligible Entrants who submit an Eligible Entry will be automatically entered into the Promotion. Entries per Eligible Entrant are limited to one vote per day for the Promotion Period.
7. All Eligible Entrant’s entries will be drawn by a panel of judges of the Promoter every fortnight from Tuesday 20 July 2010 to Tuesday 31 August 2010. Ten winners (five male and five female) will be selected at random (each being a “Prize Winner”) by the Promoter as per the below schedule. Each draw will have one male and one female Prize Winner.

Prize Winners
8. Eligible Entries are eligible to win the following Schick prize packs:

9. The Prize Winners will be notified by email on the announcement date, as per the announcement schedule above (clause 7).
10. The Promoter may conduct such further draws at the same place as the original draw as is necessary on the 1 November 2010 in order to distribute any prizes unclaimed by that date. The re-drawn Prize Winners will be notified by email immediately after the draw.
11. The decision of the judges is final and no correspondence will be entered into. This is a game of chance.

Band Winner (Schick Style Awards)
12. The winning band (“Prize Winning Band”) of the Schick Style Award will be the band with the most votes from the Eligible Entries at the end of the Promotion Period. The Prize Winning Band will be announced on www.myspace.com/sfrq.


13. The prize for the Prize Winning Band will be provided and coordinated by Schick c/o Energizer NZ Limited (Company number: 408847) 8 Gabador Place, Mount Wellington, Auckland , New Zealand. The prize includes a professionally produced music video and behind-the-scenes photo shoot, and associated travel and accommodation (Total maximum prize value NZD$12,500), and the prize must be taken by the Prize Winning Band by 30 September 2010. The Promoter (including its officers, employees and agents) excludes all liability arising in any way in relation to the prize for the Prize Winning Band. The Promoter (Fox Interactive Media New Zealand Limited) is not responsible for any coordination or any costs involved in the prize for the Prize Winning Band.

General
14. Prizes for the Prize Winners cannot be transferred to another person, exchanged for other goods and services or redeemed as cash. Any element of the prize which is unused will be forfeited and no compensation will be paid in lieu of that element of the prize. The prize may be subject to additional conditions which will be passed on to the winner at the time of accepting the prize.
15. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence) for any personal injury, or any loss or damage (including loss of opportunity) whether direct, indirect, special or consequential, arising in any way out of the Promotion, including – but not limited to – where arising out of the following: any theft, unauthorised access or third party interference; or any tax liability incurred by the winner.
16. The Promoter accepts no responsibility for any variation of any aspect of the prize due to circumstances out of its control. In any such event, an alternative element of the prize may be arranged.
17. The Promoter is not responsible for any problem or technical malfunction of any communications network or any late, lost, incorrectly submitted, delayed, ineligible, incomplete, corrupted or misdirected entry whether due to error, transmission interruption or otherwise. The Promoter reserves the right to disqualify any Eligible Entrant submitting an entry which, in the opinion of the Promoter, includes objectionable content, including but not limited to profanity, nudity, potentially insulting, scandalous, inflammatory or defamatory images or language. The judges' decision is final and no correspondence will be entered into.
18. If for any reason this Promotion is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of this Promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Promotion. The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of, entries. The Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any email or entry to be received by the Promoter on account of technical problems or traffic congestion on the Internet or at any Website, or any combination thereof, including any injury or damage to any Eligible Entrant’s or any other person's computer related to or resulting from participation or downloading any materials in this Promotion. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR THE INFORMATION ON A WEBSITE, OR TO OTHERWISE UNDERMINE THE LEGITIMATE OPERATION OF THIS PROMOTION, MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, WHETHER SUCCESSFUL OR NOT, THE PROMOTER RESERVES THE RIGHT TO SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW.
19. Entry details become the property of the Promoter. Eligible Entrants consent to the Promoter using their names, State of residence and entry details for promotional and/or marketing purposes. The winner(s) agrees to participate in reasonable promotional activities as requested by the Promoter, unless otherwise notified to the contrary at the time of acceptance of the prize. Eligible Entrants also consent to being contacted by Schick and to their name, photos, prize photos and videos being used by Schick for promotional and/or marketing purposes.
20. Without limiting the foregoing, Eligible Entrants’ personal information provided in connection with this promotion will be handled in accordance with the MySpace privacy policy (see www.myspace.com).
